The following Regulations provide for the residues of plant protection products in foods:
Maximum levels
- Regulation (EC) No 396/2005 of the European Parliament and of the Council on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (incl. amendments)
- Annex I to Regulation (EC) No 396/2005 lists the products to which the maximum residue limit is applied. Annex I has been amended several times and the most recent valid product classification is presented in Commission Regulation (EU) 2018/62 replacing Annex I to Regulation (EC) No 396/2005 of the European Parliament and of the Council.
- Commission Regulation (EC) No 149/2008 amending Regulation (EC) No 396/2005 of the European Parliament and of the Council by establishing Annexes II, III and IV setting maximum residue levels for products covered by Annex I thereto (and its correction). The Regulation establishes the maximum residue levels.
- Commission Regulation (EC) No 260/2008 amending Regulation (EC) No 396/2005 of the European Parliament and of the Council by establishing Annex VII listing active substance/product combinations covered by a derogation as regards post harvest treatments with a fumigant.
Control and sampling
- Commission's annually issued Implementing Regulations concerning a coordinated multiannual control programme of the Union to ensure compliance with maximum residues levels of pesticides and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin can be found on the Commission's website. The three-year Implementation Regulations provide for the control of pesticide residues, and on the mandatory foods and active substances to be covered by the monitoring programme.
- Commission Directive 2002/63/EC establishing Community methods of sampling for the official control of pesticide residues in and on products of plant and animal origin and repealing Directive 79/700/EEC (incl. amendments). The Directive has been enforced in Finland by Decree 475/2004 of the Ministry of Trade and Industry on methods of sampling for the official control of pesticide residues in fruit, vegetables, as well as cereals, eggs, and egg products.
Foods intended for infants and small children
- Decree 1215/2007 of the Ministry of Trade and Industry on pesticide residues in children's foods (in Finnish). This Decree enforces Commission Directive 2006/125/EC on processed cereal-based foods and baby foods for infants and young children.
- Decree 1216/2007 of the Ministry of Trade and Industry on infant formulae and follow on formulae (in Finnish). This Decree enforces Commission Directive 2006/141/EC on infant formulae and follow-on formulae and amending Directive 1999/21/EC.
- Commission Delegated Regulation (EU) 2016/127 supplementing Regulation (EU) No 609/2013 of the European Parliament and of the Council as regards the specific compositional and information requirements for infant formula and follow-on formula and as regards requirements on information relating to infant and young child feeding
